I : Applicability
The purpose of these General Terms of Sale is to define the rights and obligations of the parties in the
context of on-line selling of products proposed in this e-shop by COULEURS-CARAÏBES.NET.
We will be able to modify the present general conditions of sale, however we will commit to inform the
customers on our site.
II : Order
We commit to accept your order in the terms of these general terms of sale, within the limit of our stocks
available or our supplier's. By the time of your order, we inform you of the availability of the items you
wish to acquire. Nevertheless, if despite our vigilance some items are temporarily or definitively
unavailable, we will inform you by e-mail and we will invite you to cancel or modify your order.
When you confirm your order, you accept the integrity of these general terms of sale at your disposal on
the site, and admit having a perfect knowledge of them, giving up in fact to raise an objection. The act
of purchase involving acceptance of these general terms of sale, this confirmation as well as the whole
data which we will have recorded will constitute the proof of our transactions.
III : Price
We reserve us the right to modify our prices constantly, but we commit us to apply the prices indicated at the time of your order.
A minimum order of 50.00 € is required.
For all order over 500.00 €, COULEURS-CARAÏBES.NET will offered your delivery by Registred Colissimo.
IV : Payment
The payment is exigible immediately at the date from the order. According to your country, You can pay by credit card
(SSL Protected server), bank check or credit transfer.
Case of online payment :
When you pay by credit card, you are invited at the end of your order to indicate to PAYPAL your card number and
the validity date. Various accesses to servers of authorization are then carried out in order to check the data to
avoid the abuses and the frauds. For that, PAYPAL's server is in encrypted mode and all conveyed information is
coded (SSL protocol). Nothing forwards deciphered on the Web.

V : Delivery
Products are delivered to the address indicated by the customer in the order form. Our sendings are addressed out on standard in Registred Colissimo by "The French Post service".
For the Metropolitan France, the French departments and Overseas Territories, Andorra, Monaco and the Dutch West Indies, you profit from an insurance to the amount of 800.00 Euros.
For the other destinations, the insurance is 1.500 Euros maximum. You could in addition choose shipment by "International Mail Service". In this case, you profit from a full cover covering the risks of loss, deterioration or spoliation.
The orders are treated only
with reception of notification by PAYPAL, check of payment or confirmation by our bank of your credit transfer.
VI : Returns and settlement
We take the greatest care to the packing of the delivered items. With the reception of your parcel, you
must immediately check the conformity of your delivery compared to your purchase order. At the reception
of your parcel, you must open the parcel in front of the conveyor and check the good condition of items
before signing the delivery order. If you have any doubts about the quality of the ordered goods, you must
have necessary reserves to the conveyor to obtain a resort against the haulier company. You should not
withdraw the labels which are on the products, under risks of cancellation of the guarantee. The labels,
the delivery order accompanying the items are essential for the guarantee. Packing must be preserved.
In the opposite case, the customer cannot profit from his resort. In the case which the customer did not
have reserves, he cannot from his resort. All the recourses about a defect of the delivered goods, number,
erroneous reference, compared to accepted order, must be formulated by mail or letter within 48 hours with
reception of the goods, without neglecting the recourse against the conveyor, in the absence of what, the
right of resort will lose. The customer shall have a period of seven (7) working days as from the delivery
to return any product for exchange or refund without any penalty. The cost of return will be borne by the
customer, except in case of error from COULEURS-CARAÏBES.NET. Only the complete products, in good
condition and in their original packing such as we will have delivered will be returned or exchanged. The
products will be returned to the following address :

At the end of this seven (7) working days, the products delivered will be considered in conformity with
your order and accepted by you.
VII : Guarantee of the hidden defects and responsibility
In case which the items that we delivered to you present hidden defect, we will be able, with our choice,
to eliminate this vice or to replace the faulty item by another. If we cannot correct the defect, replace
the faulty item, and this in a relative short time, you will be able to return it against refunding of the
price and the expenses of the return. The items displayed on our site are in accordance with the French
legislation. We decline any responsibility in the case that the delivered item would not respect the
legislation of the country of delivery. We commit to take all the care of use in the profession for the
customer's satisfaction. Nevertheless, our responsibility could not be retained in the event of failure
with our contractual obligations because of a fortuitous occurrence or a case of absolute necessity such
as -and without limitation- the disasters, strikes, fires, floods, failure of the communication, transports,
breakdown of transport or in fact of your intrigues.
VIII : Applicable law and jurisdiction
The present general terms of sale right are subjected to the French. All the lawsuits relating to the trade
existing between you and us are subjected to the exclusive competence of the French jurisdictions. |
